This action is to recover the sale price for securities alleged to have been sold by the plaintiff to the defendants. The jury found there was an agreement to purchase the stock and that the defendant Brandau was an agent of all the other named defendants. The trial court found the damages to be $15,000, the sale price, and entered judgment for that amount plus costs. Prior to entry of judgment, the defendants made a motion for judgment notwithstanding the verdict but did not make a motion for a new trial. The defendants appeal. Such facts as are necessary for a Discussion of the issues will be set forth in the opinion.
